By making a driving lesson booking with the BDT, the client is agreeing that they understand and accept the basic Terms and Conditions below.
Terms and Conditions are further agreed to when logging into the Total Drive (TD) mobile application*1 used by both client and instructor to track a client’s lessons, payments, theory training and practical training progress. BDT assumes that, by the uptake of services provided in relation to driver training, the client accepts all Terms and Conditions.

- Qualifications
The Driving & Vehicle Standards Agency (DVSA) is the government body that examines, licences, and controls the standards of all driving instructors in the United Kingdom (UK). Your BDT instructor is examined, licenced, and subject to regular standards checks by the DVSA. BDT strives to deliver the highest quality of service and training. If you have any questions or doubts about your training, please contact BDT to discuss them.
- General Conduct
BDT is bound by a professional code of conduct ensuring a professional and ethical manner, politeness, tidiness, and a smoke free vehicle at all times. Mobile telephones must not be used during a driving lesson to comply with current UK law.
BDT instructors are subject to a UK DBS*2 check and required to declare any new or pending driving convictions or criminal convictions or allegations.
Clients must not smoke or use a mobile telephone during lessons to comply with current UK law and must behave in a manner that does not provoke or intimidate the instructor.
Aggressive or violent behaviour either physical or verbal toward the instructor, including but not limited to; insulting or degrading language, innuendo, malicious allegations, racist, sexist, ageist, or homophobic remarks, comments relating to disability, perceived gender, religion, belief, or any other personal characteristic will not be tolerated. In this event, all future lessons will be cancelled and tuition with BDT will cease with immediate effect. In this event any monies that have been prepaid by the client may not be refunded.
- Tuition
Tuition is only available to clients who meet the following criteria:
- Clients must be aged a minimum of 17 years or older.
- Clients must hold a valid UK provisional or full driving licence and be legally entitled to drive in the UK.
- Clients must, via DVLA online licence check*3, certify that they hold a valid UK provisional driving licence.
- Clients must pass the DVSA eyesight check before beginning driving lessons. Clients must be able to read a standard UK registration mark at 20.5 metres. Instructors are required by law to cancel driving lessons should a client not be able to meet this condition.
- Lessons
Following the submission of your contact details by BDT, it is the responsibility of both BDT and the client for agreeing all matters relating to timing, meeting location and duration of individual lessons.
If clients need a break from tuition for any reason it is the responsibility of the client to inform BDT to reschedule or cancel any booked future appointments. Any booked lessons not cancelled or rescheduled will remain chargeable.
Clients must notify BDT of any change in status that may affect your ability to legally continue driving tuition, for example but not limited to, any change in health or any endorsements or loss of a valid provisional driving licence.
All instruction and advice provided during driver training, is for the safety of all road users, including the client. The client’s responsibility is to drive the car as safely as able and possible. The instructor’s responsibility is to help the client to drive the car as safely as possible and within an individual client’s ability. Clients should be aware this may include physical intervention to control on safety critical situations.
BDT responsibility and aim is to teach safe driving for life and for clients to reach the correct driving standard via the recommended syllabus issued by the DVSA within the minimum number of driving lessons needed, appropriate to the individual client.
Whilst legally supervised private practice is encouraged, this must be in agreement with BDT to ensure it remains within the guidelines of ongoing tuition. BDT can in no way be held liable for errors a client may make or any resulting accidents caused whist driving during private practice either before or after passing their driving test.
BDT reserve the right for DVSA Examiners, ADIs, PDIs and/or other professional colleagues to observe a client’s lesson without notice. This may be for a BDT instructor’s CPD rather than the benefit of the client.
- Payments
BDT does not accept cash or cheque payments. BDT does not accept any driving lesson vouchers issued by third parties, e.g., Wowcher, Groupon, etc. All payments must be made via bank transfer*4 a minimum of forty-eight (48) hours prior to commencement of a booked lesson. Overdue payment may mean an allocated lesson time is offered to an alternative client without notice.
Standard advertised rates apply to driving tests including time collect and drop a client at a chosen address.
Cheaper hourly rates MAY be offered occasionally on a promotion basis for pre-paid block bookings at BDT discretion.
- Price Changes
The cost of tuition is based on the stated lesson rate at the time of booking and will be honoured for a period of up to, but not necessarily exceeding, six (6) months. However, where prices are increased, and lessons are scheduled and/or booked after the first six (6) month period the new rate will apply.
BDT reserve the right to make price increases at any point during the fiscal year as a result increases in business running costs.
Price changes may also apply in the following circumstances:
- Where a client moves postcode area.
- Where a client requests to switch instructors.
- Where a client decides to change from manual to automatic transmission.
- Transferability of Lessons
A client cannot sell, or transfer lessons purchased in their name to another person, group, or body.
- Use of Vehicle
BDT will make available a vehicle for a client’s use during driving lessons. The vehicle will be properly insured for the purpose of driving lessons and practical driving tests. The vehicle will be fitted with dual controls, correctly maintained, and always kept clean and tidy. On occasion it may be necessary to change the vehicle due to breakdown, maintenance, or safety issue. BDT reserves the right to change the vehicle at any time.
Use of BDT vehicles for test purposes is at the discretion of the instructor.
- Test Bookings
BDT does not currently provide a driving theory test or practical driving test booking service.
Clients must take responsibility for their own training, preparation, and booking for the Official DVSA Driving Theory Test. BDT can provide clients with guidance regarding the theory test. BDT will provide the Theory Test Suite, which is a free to use app within TD, along with access to Learning videos.
Clients will be notified by BDT when a safe and competent standard of driving is reached. Clients must not book a practical driving test until such time as BDT is confident of a client’s ability and is ‘test ready’. BDT reserve the right to refuse the use of a vehicle if a practical driving test is booked by a client in advance of a safe and competent standard being reached.
BDT will not be involved in arranging cancellations or changes to any driving theory test or practical driving test bookings made by individual clients. Clients are responsible for notifying BDT of any practical driving test bookings made, and it remains the client’s responsibility to ensure that BDT can provide services and vehicle for that booking.
Should a client wish to cancel and/or move the date of a practical driving test, the DVSA stipulates a minimum of three (3) working days’ notice. Less than three (3) working days’ notice means the forfeit of the DVSA driving test fee.
- Cancellation of Lessons
A minimum of twenty-four (24) hours’ notice must be provided by the client for any change, postponement, or cancellation to a booked driving lesson. BDT reserve the right to rearrange lessons(s) at short notice in the event of mechanical breakdown or other unforeseen circumstance beyond their control.
Cancellations by the client must be made by telephone call, voicemail message, and text message. If clients do not give the required twenty-four (24) hour notice period for cancellation of lesson(s) the client will still be liable for the lesson(s) fee at standard rate.
If for any reason, outside of the instructor’s control, it is not possible to deliver the full duration of a driving lesson, it is BDT responsibility to record any remaining time in TD and add to a subsequent driving lesson. It is the responsibility of the client to ensure that any unused paid time is recorded via their own personal medium.
BDT reserves the right to refuse to continue with a driving lesson if there is reason to believe a client is in any way under the influence of alcohol, illegal drugs or adversely affected by prescription medication.
- Refund Policy
Clients are entitled to cancel prepaid tuition at any time (for the provision relating to the cancellation of individual lessons please see (‘Cancellation of lessons’). If a client has not taken any lesson(s) at the time of cancellation the client will be entitled to a full refund of any amounts paid to BDT, subject to the items below.
Any lesson(s) already taken by the client at the time of cancellation will not be eligible for refund.
BDT may request additional information from the client to confirm a client’s identity to comply with the Money Laundering Regulations 2007. BDT may also use this information to ensure adherence to Merchant Operations for card collection facilities.
Refunds will be via bank transfer and may take up to ten (10) working days to reach a client’s account.
Notwithstanding any of the above, no request for refund after a period of twelve (12) months has lapsed from the first date of payment for any lesson type will be met.
- Insurance
BDT will ensure the proper motor insurance to always include the operating of the vehicle by the client during any tuition.
- Limitation of Liability
BDT are not liable to you for any loss or damage caused, where and to the extent that:
There is no breach of any legal duty owed to the client by the relevant person or body.
Such loss or damage is not a reasonably foreseeable result of such a breach.
Any such loss or damage, or increase in the same, results from any breach or omission by the client.
Any such loss or damage results from circumstances of matters outside of the reasonable control of the relevant person or body
BDT shall not, in any event be liable for losses relating to any business interests the client may have included, without limitation, lost profits, lost earnings, loss of opportunity or business or business interruption.
BDT is not party to the contract for driving tuition itself, which is between the client and the client’s instructor. This does not affect any liability that BDT may have for any loss or damage the client may incur directly as a result of any breach (including negligence) by it or them of any legal duty owed by it or them to the client.
Nothing in these terms and conditions will affect any statutory rights you may have as a consumer. BDT reserves the right to change and amend these Terms and Conditions at any time without prior notice. Any revisions to these Terms and Conditions will appear here.
- Data Protection
Any Personal Data provided by the client will be held securely and in accordance with the Data Protection Act 2018*5. BDT will only use the data provided to supply a client’s details to any Police Authority, Insurance Company or Fraud Investigation Team should we legally required to do so. BDT will not pass a client’s details to any third parties without the client’s consent.
BDT reserve the right to make both interior and exterior video and audio recordings of lessons for insurance purposes and for instructor / client security. Recordings may also be used for instructor CPD and, following any incident or complaint, may be surrendered for review by relevant authorities on demand. Recording will not be shared on any media platforms without the explicit consent of the client.
- Complaints Procedure
Concerns or complaints should be submitted via email at the earliest opportunity to BDT at: info@bespokedrivertraining.co.uk
BDT aim to respond to any submitted written complaint within ten (10) working days.
Any complaints will be considered in accordance with the ADI Code of Practice*6. Should a satisfactory resolution not be reached by BDT, where appropriate, client’s will be directed to the relevant external body.
